DMCA Takedown Policy

Overview

Heriot respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe that content on heriot.ai infringes your copyright, you may submit a takedown notice as described below.

Filing a DMCA Takedown Notice

To file a valid DMCA takedown notice, you must provide our designated agent with the following information in writing:

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list of those works.
  2. Identification of the infringing material: A description of the material you claim is infringing and that you want removed, with enough detail for us to locate it (e.g., the full URL of the page).
  3. Your contact information: Your name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in your notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Please include “DMCA Takedown Notice” in the subject line. We will process valid notices promptly and remove or disable access to infringing material as required by law.

Counter-Notification Process

If you believe that material was removed or disabled as a result of mistake or misidentification, you may file a counter-notification. A valid counter-notification must include:

  1. Identification of removed material: A description of the material that was removed and the location where it appeared before removal (e.g., its former URL).
  2. Your contact information: Your name, mailing address, telephone number, and email address.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, any judicial district in which Heriot may be found.
  4. Perjury statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will provide the complaining party with a copy and inform them that we will restore the removed material within 10 to 14 business days unless our designated agent receives notice that the complaining party has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material.

Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights.

Misrepresentation Warning

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.
